Moriah Heights Auditorium
Usage Policy & Request Form
This page contains the guidelines and responsibilities for any individual or organization that wishes to use the Moriah Heights Auditorium. Please read the material below to make sure all parties understand the requirements of providing for everyone’s safety and keeping the Moriah Heights Auditorium a well maintained and safe location for future use.
Upon completion of the form linked below, this agreement is made and entered into between the SDARM Northern California Conference (“NCC”) and the signing individual (“Renter”) for the dates recorded in the designated fields of the form.
This agreement applies to the Renter’s use of the NCC Auditorium as described on page 1 and following the terms and expectations of the rental.
The Renter agrees to compensate the NCC for expenses made solely for the purpose of their event. Any additional costs incurred by the NCC due to the renter’s use of the property are due two (2) days after they are incurred.
Upon completion of the form, the NCC Administrative Director will forward the details to the NCC Executive Committee for their approval, and will communicate that approval to the Renter once obtained.
Site Representative
A representative from the NCC may be present during all hours of use of the rental. The representative will be responsible for the opening and closing of the rental and will usually be available to answer any question regarding use of the rental in person or via cell phone. The representative will be specified in the contract section of this agreement. The representative is not responsible for set-up or clean-up. In some cases, this requirement may be waived due to lack of personnel available.
Site Condition
The NCC wants to make every event in the Auditorium a special and welcome experience. Therefore, every effort will be made to allow the renter to prepare decorations reflecting their creative requirements, should decorations be needed. At the end of the rental, there should be no garbage or litter, marks on floors, walls, or furniture or breakage of equipment. The use of nails, staples, screws, etc. on walls, tables or other equipment is not permitted. Any decorations, if used, must be carefully removed immediately following the event. Renter shall replace or repair any cables or other Rental facilities damaged by their use of the Rental.
Storage
No storage of materials (banners, rental dishes, decorations, chairs, etc.) at the Auditorium is permitted without prior approval. Please list any materials that need to be stored at the Auditorium in the space provided on the use request form. All stored materials must be removed from the premises after the rental period is over. Any items remaining in the Auditorium after the rental will be either donated, sold, or disposed of.
Maintenance Issues
While using the Auditorium, the renter shall report all maintenance problems (burnt-out light bulbs, faulty or damaged equipment, etc.) to the site representative. Upon renter’s request, the NCC shall perform maintenance and repair work to the extent that staff is available.
Safety
Renter shall maintain safe exit pathways at all time in the Auditorium. In particular, no obstructions are allowed which will interfere or prohibit passage by occupants to the “exit” doors in case of an emergency building evacuation. The number of people at the event shall not exceed the building capacity specified.
Conduct
Renter and guests shall use the premises in a considerate manner at all times. Conduct deemed disorderly at the sole discretion of the NCC shall be grounds for immediate expulsion from the premises and conclusion of the rental period. In such cases refunds of the event costs will not be available. The Auditorium will be in a clean condition prior to your event. Within twenty-four (24) hours following the event, you are required to return the space to the same clean condition in which it was found. All equipment/decorations must be removed immediately following your event. This time frame is subject to change according to other events that are scheduled to happen in the event space or the needs of other entities that use the space on a regular basis (e.g. Whispering Pines Christian School). All activities during the event must be deemed appropriate under the Principles of Faith of the Seventh Day Adventist Reform Movement and NCC Working Policies.
Clean-Up Responsibilities
The clean-up responsibilities of the renter include:
Cleaning and returning NCC tables and chairs to their original location
Returning any media equipment to the appropriate location
Removing all decorations
Removing all litter
Emptying trash and garbage cans
Sweep any debris outside of the main entrance to the Auditorium
Vacuum carpet inside of the Auditorium
Extension of Reservation Time
Renter may only exceed their reservation time limit if schedules permit it. This must be communicated to the NCC Administrative Director for coordination as soon as possible.
General Provisions
I. NCC agrees to provide renter use of the Auditorium and any related services described in accordance with this agreement, and the renter agrees to use the facilities and services and to compensate the NCC in accordance with this agreement
II. The NCC shall retain ownership of the Auditorium, including the building, all fixtures, wall and floor coverings and media equipment. The NCC does not own any of the renter’s equipment, supplies and materials used during the rental.
III. It is understood and agreed that with respect to the Auditorium, this is solely a use agreement and that the renter has not been given and is not given a lease of said premises or any part thereof and acquires no easement, license, or other interest in said property owned or constructed by the NCC. Storage of the renter’s equipment, supplies, and materials is not authorized under this agreement except as outlined in this agreement.
IV. The NCC shall provide property insurance coverage for the Auditorium on the same terms that all other NCC property is insured. NCC shall not provide insurance of any kind for any renter property, including the property listed to be stored or setup beforehand, nor will the NCC provide insurance for any renter programs or activities. Renter is solely responsible for insuring renter property in the Rental and renter’s programs and activities.
V. The NCC shall provide routine maintenance for the Auditorium similar to that provided for all NCC premises.
VI. Renter may not assign any right or obligation under this agreement. Any attempted or purported assignment of any right or obligation under this agreement shall be void and of no effect.
VII. Either party may terminate this agreement with or without cause by providing 10 days’ notice in writing to the other party. The NCC may terminate this agreement at any time without prior notice in the event that the renter commits a material breach of the terms of this agreement. Upon termination, this agreement shall become of no further force or effect whatsoever and each of the parties hereto shall be relieved and discharged from the rights and obligations of this agreement, subject to payment for use of the Rental prior to the expiration of the notice of termination.
VIII. This agreement is entered only for the benefit of the parties executing this agreement and not for the benefit of any other individual, entity or person.
The failure by the NCC to enforce any of the renter’s obligations or to exercise NCC's rights per this agreement shall in no event be deemed a waiver of the right to do so thereafter.
